1. This agreement
MaxShot is an iPhone app made by Max Bassett ("I", "me"). These terms are the agreement between you and me covering your use of the app. By installing or using MaxShot, you accept them. If you do not accept them, do not use the app.
2. What MaxShot is right now
MaxShot builds recap videos from photos and videos already on your device. It is currently in beta, distributed through Apple's TestFlight, and free. Beta software is unfinished by definition: expect bugs, expect features to change or disappear, and do not rely on it for anything you cannot afford to lose.
If paid features are introduced later, the terms covering them will be presented before you are asked to pay. Nothing here obliges you to pay for anything.
3. Your photos, videos, and recaps are yours
You keep every right you have in the photos and videos you bring to MaxShot and in the recaps you make with it. I claim no ownership of them and no licence to use them. I could not use them if I wanted to: the app has no servers and no account, your media never leaves your device, and I never receive a copy. The privacy policy sets out the detail.
Because your work lives only on your device, keeping it safe is your responsibility. Deleting the app deletes your projects. Back up anything you care about — exporting a finished recap to your photo library is the simplest way.
4. Music and other people's material
MaxShot does not supply music. It lets you score a recap using audio files you provide from your own device, and you are responsible for having the right to use whatever you add.
This matters more than people expect. Owning a copy of a song — buying it, subscribing to a service that streams it — does not give you the right to put it in a video you publish. A recap you keep for yourself and show to family is a different matter from one you post publicly, and the risk of the second one is yours, not mine. The same goes for any photo or video in your recap that somebody else created.
If a recap you make leads to a copyright claim, a takedown, or any other complaint, that is between you and the rights holder.
5. How you may not use MaxShot
You agree not to use MaxShot to:
- create or handle material that is unlawful, or that sexualises children;
- infringe anyone's copyright, trademark, privacy, or publicity rights;
- harass, threaten, or impersonate anyone;
- reverse engineer, decompile, or attempt to extract the app's source code, except to the extent the law says you may regardless of this term;
- redistribute or resell the app, or present it as your own.
6. Services the app connects to
MaxShot optionally connects to Google Photos, and uses services provided by Apple. Those services have their own terms, which you are also bound by when you use them, and I do not control them. If Google or Apple changes or withdraws something MaxShot relies on, a feature may stop working through no fault of either of us.
7. No warranty
MaxShot is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. I do not promise the app will be uninterrupted, error free, or that it will produce any particular result. I do not promise to keep it available, to keep supporting it, or to release further versions.
Some places do not allow the exclusion of implied warranties. If yours is one, parts of this section may not apply to you, and you may have rights this agreement cannot take away.
8. Limits on liability
To the fullest extent the law allows, I am not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost media, arising out of your use of MaxShot — even if I have been told such damages are possible.
Where liability cannot be excluded, my total liability to you for all claims is limited to the greater of the amount you paid me for MaxShot in the twelve months before the claim, or twenty five US dollars.
9. Age
You must be at least 13 years old to use MaxShot. If you are under the age of majority where you live, you may use it only with the involvement of a parent or guardian, who accepts these terms on your behalf.
10. Ending this agreement
You may end it at any time by deleting the app. I may stop distributing MaxShot, or stop providing any part of it, at any time. Sections 3 through 8 survive the end of this agreement.
11. Changes to these terms
I may update these terms. The effective date at the top will change, and material changes will also be noted in the app. Continuing to use MaxShot after a change means you accept the updated terms. The current version always lives at maxshot.app/terms.
12. Governing law
These terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict of laws rules, and the courts located in South Carolina will have jurisdiction — except where the law of the place you live gives you the right to bring a claim locally, which this term does not take away.
13. Apple
Where you obtained MaxShot through Apple:
- This agreement is between you and me only. It is not with Apple, and Apple is not responsible for MaxShot or its contents.
- Apple has no obligation to provide any support or maintenance for MaxShot.
- If MaxShot fails to conform to any warranty that applies, you may notify Apple, and Apple will refund any purchase price. To the maximum extent the law allows, Apple has no other warranty obligation of any kind.
- I, not Apple, am responsible for addressing any claim that MaxShot infringes someone's intellectual property rights, and for any product liability or regulatory claim relating to it.
- You confirm you are not located in a country subject to a US government embargo or designated as terrorist supporting, and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third party beneficiaries of this agreement and may enforce it against you.
